These Terms and Conditions (“Terms”) govern your use of the website https://rajaandthewhales.com and the booking of whale and dolphin watching tours and water sports operated by Raja and the Whales (“we”, “us”, “our”).
By accessing our website, requesting a quote, or making a booking, you agree to these Terms. If you do not agree, do not use our services.

2. Services
We offer whale and dolphin watching and related water sports departing from Mirissa, Sri Lanka (or the meeting point stated at booking), subject to weather, sea conditions, safety rules, and seat availability.
Tour duration, departure time, pricing, and inclusions are as shown on the website or in your booking confirmation / quote at the time of purchase.
3. Eligibility and bookings
- You must be at least 18 years old (or the age of legal capacity in your jurisdiction) to make a booking on behalf of a group.
- You confirm that all information you provide (including passenger names, nationality, and passport numbers) is accurate and complete.
- Bookings are subject to availability. A booking is confirmed only when we accept it and, where online payment applies, when payment is successfully completed via PayHere.
- If payment is not configured or you submit a quote request, that submission is a request only — it is not a confirmed paid booking until we confirm and (if required) payment is completed.
4. Prices and payment
- Prices are displayed on the website in the currency shown at checkout (e.g. USD) and may change until your booking is confirmed.
- Online payments are processed securely by PayHere. By paying, you also agree to PayHere’s applicable terms: https://www.payhere.lk/legal
- You are responsible for ensuring sufficient funds and providing accurate payment details on PayHere’s checkout.
- We are not responsible for payment failures caused by your bank, card issuer, or PayHere network issues beyond our control.
5. Passenger information and documents
For safety and regulatory reasons you must provide required passenger details (including passport information for adults and children where requested). You are responsible for ensuring each passenger has valid travel documents. We may refuse boarding if mandatory details are missing or appear invalid.
6. Pickup arrangements
Where you request hotel / accommodation pickup:
- Free or paid pickup options (e.g. Mirissa vs outside Mirissa) apply as described at booking.
- We (or our partners) will typically contact you before the tour to confirm pickup timing.
- Incorrect addresses or unreachable contacts may result in missed pickup without refund, subject to our Refund Policy.
7. Tour operations, safety, and wildlife
- Whale and dolphin sightings are not guaranteed. Nature and sea conditions vary.
- The captain / crew may change the route, shorten, delay, or cancel a tour for safety, weather, mechanical, or regulatory reasons.
- You must follow all safety instructions, wear life jackets when required, and behave respectfully toward wildlife and other passengers.
- We may refuse boarding or remove a passenger who is intoxicated, abusive, or endangers others, without refund where you are at fault.
8. Cancellations and refunds
Cancellations, changes, and refunds are governed by our separate Refund Policy. Please read it carefully before booking.
9. Weather and force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including severe weather, storms, harbour closures, government action, strikes, or emergencies. Remedies in such cases are as set out in the Refund Policy (e.g. reschedule or refund at our discretion / as stated there).
10. Intellectual property
All website content (text, branding, photos, design) belongs to Raja and the Whales or its licensors. You may not copy or reuse it without prior written permission.
11. Acceptable use
You agree not to:
- Misuse the website or booking system
- Submit false or fraudulent information
- Attempt to interfere with site security or payment processes
12. Limitation of liability
To the fullest extent permitted by Sri Lankan law:
- Our total liability arising from a booking is limited to the amount you paid for that booking.
- We are not liable for indirect, incidental, or consequential losses (including loss of enjoyment, travel costs, or accommodation) except where liability cannot be excluded by law.
- Nothing in these Terms excludes liability for death or personal injury caused by our negligence where such exclusion is not permitted by law.
Marine activities involve inherent risks. You participate at your own risk to the extent allowed by law, while we take reasonable care for passenger safety.
13. Indemnity
You agree to indemnify us against claims arising from your breach of these Terms, inaccurate passenger information, or your (or your group’s) misconduct on the tour, except to the extent caused by our negligence.
14. Privacy
Personal data is handled according to our Privacy Policy. By booking, you consent to processing of passenger data as needed to run the tour and meet legal / safety requirements.
15. Changes to services or Terms
We may update these Terms or tour offerings at any time. The version posted on the website at the time of your booking applies to that booking. Material changes will be reflected by updating the “Last updated” date.
16. Governing law
These Terms are governed by the laws of Sri Lanka. Courts in Sri Lanka shall have jurisdiction, without prejudice to any mandatory consumer rights you may have.
